1. General Provisions
1.1. These online store terms and conditions (hereinafter referred to as the Terms) constitute a legally binding agreement between the Buyer and the Seller, Remap UAB (hereinafter referred to as the Seller), which governs the rights and obligations of the Parties. The application of any terms and conditions of the Customer is excluded unless expressly agreed otherwise by the Seller.
1.2. By accessing and using the Seller’s website, the Customer agrees to be bound by the present Terms and Conditions.
1.3. The Seller reserves the right to amend, modify, or supplement the present Terms and Conditions at any time. The Buyer shall be notified of any changes to the Terms and Conditions via publication on the online store’s website.
2. Conclusion of a Purchase and Sale Agreement
2.1. The Purchase and Sale Agreement between the Buyer and the Seller shall be deemed concluded upon the Buyer placing an order for goods in the online store after having reviewed the present Terms and Conditions. The order shall be considered duly submitted once the Seller has received payment for the goods, and the Buyer has received an order confirmation from the Seller via email or telephone.
3. Seller’s Rights
3.1. In the event of material circumstances, the Seller shall have the right to temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. In the event that the Buyer attempts to interfere with the operation, stability, or security of the online store, or otherwise breaches their obligations, the Seller shall have the right to restrict or suspend the Buyer’s access to the online store without prior notice.
4. Seller’s Obligations
4.1. The Seller undertakes to provide access to the online store’s services, the terms of use of which are governed by the present Terms and Conditions.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method selected by the Buyer, in accordance with the provisions of the present Terms and Conditions.
4.3. In the event that, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online store, the Seller shall be entitled to terminate the Purchase and Sale Agreement, provided that the Buyer is duly notified in advance. In such case, the Seller may offer an equivalent or similar product. If the Buyer refuses such offer, the Seller shall refund the amounts paid within 3 (three) business days.
4.4. Where the Buyer exercises the right set out in Section 5.2 of the present Terms and Conditions, the Seller undertakes to refund the amounts paid by the Buyer within 5 (five) business days from the date of receipt of the returned goods.
4.5. The Seller may withhold any refund payable to the Buyer until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been dispatched to the Seller, whichever occurs first.
5. Buyer’s Rights
5.1. The Buyer shall have the right to purchase goods from the online store in accordance with the present Terms and Conditions.
5.2. The Buyer shall have the right to withdraw from a purchase agreement concluded in the online store by notifying the Seller in writing no later than within 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right referred to in Section 5.2 only provided that the goods have not been damaged or their appearance materially altered, their quality has not been impaired, the packaging remains intact, and the goods have not been used.
6. Buyer’s Obligations
6.1. The Buyer shall be obliged to pay for the purchased goods and accept them in accordance with the procedure established in the present Terms and Conditions.
6.2. If the Buyer, at the time of delivery, refuses to accept the goods without justified cause, the Buyer shall be obliged to cover the costs of returning the goods upon the Seller’s request.
6.3. Upon delivery of the goods, the Buyer shall inspect the condition of the package and the goods together with the Seller or the person effecting delivery.
6.4. By using the online store, the Buyer confirms their agreement to the present Terms and Conditions and undertakes to comply therewith.
7. Prices of Goods
7.1. The prices of goods in the online store are stated in euros and include value-added tax (VAT). Upon confirmation of the order, any applicable delivery charges shall be added to the total order amount.
8. Ordering and Payment
8.1. When accessing the online store, the Buyer shall select the goods they wish to purchase and add them to the shopping cart. After completing the selection, the Buyer shall provide the personal data required for order fulfilment, including name, surname, delivery address, telephone number, email address, and any additional information relevant to the delivery of the ordered goods. The Buyer shall confirm that they have read the present Terms and Conditions and submits the order accordingly.
8.3. Payment may be made via online banking services of Swedbank, SEB, Luminor, and Artea, as well as by Visa/MasterCard payment cards. All payments shall be made in euros. Payment processing is carried out via the Montonio.lt payment platform.
9. Delivery
9.1. When placing an order for goods, the Buyer shall provide an accurate delivery address.
9.2. The Buyer shall accept the goods in person. If the Buyer is unable to accept the goods personally, but the goods are delivered to the address specified by the Buyer, the Buyer shall not be entitled to raise any claims in respect of delivery to an unauthorised person.
9.3. The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the respective product descriptions.
9.4. The characteristics of all goods offered for sale are set out in the description accompanying each item. The Seller shall not be liable for any discrepancies between the actual appearance of the goods and their depiction in the online store (including colour, shape, or other parameters), which may arise due to the characteristics of the Buyer’s display settings.
9.5. In the event that the Buyer withdraws from the purchase agreement, the Buyer shall be refunded all amounts paid, including any delivery costs incurred by the Buyer.
10. Returns
10.1. Goods of satisfactory condition may be returned within 14 days from the date of receipt. Defects in goods sold shall be remedied, and defective goods shall be repaired, replaced, or refunded in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions shall apply:
10.2.1. The returned item shall be in its original, undamaged packaging (this provision shall not apply in the case of defective goods);
10.2.2. The item must not have been damaged by the Buyer;
10.2.3. The item must be unused and must retain its original appearance, including intact labels and protective films, where applicable (this provision shall not apply in the case of defective goods);
10.2.4. The returned product must be in the same condition as when it was received by the Buyer (this provision shall not apply in the case of defective goods);
10.2.5. The Seller shall be entitled to refuse accepting returned goods if the return conditions set out herein are not satisfied;
10.2.6. Returns shall be carried out in the manner specified by the Seller within 14 (fourteen) days from the date of receipt of the goods (this provision shall not apply in the case of defective goods; in such cases, returns shall be processed within the statutory warranty period);
10.3. The return and exchange of goods of satisfactory condition shall be governed by Article 6.22810(1) of the Civil Code of the Republic of Lithuania.
10.4. Any payments made for goods returned and accepted by the Seller shall be refunded to the Buyer’s bank account no later than within 5 (five) days from the date of receipt of the returned goods, unless otherwise agreed between the Seller and the Buyer.
11. Final Provisions
11.1. The present Terms and Conditions have been prepared in accordance with the laws of the Republic of Lithuania.
11.2. The present Terms and Conditions, as well as the relationship between the Parties arising therefrom, shall be governed by and construed in accordance with the laws of the Republic of Lithuania.
11.3. All disputes arising out of or in connection with the implementation of the present Terms and Conditions shall be resolved through negotiation. Where an agreement cannot be reached, such disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties shall be released from their obligations under the present Terms and Conditions where the performance of such obligations becomes impossible due to unforeseen circumstances beyond the reasonable control of the Parties (force majeure).
